Hereinafter referred to as “SELLER” and “BUYER” for the purchase and sale of the described dog / puppy below on the following terms and conditions of the sale. This dog/ puppy is a purebred Toy or purebred Miniature Australian Shepherd.

Sandy Creek Aussies is a registered Kennel name. The first words in the Registered name of said puppy must be SANDY CREEK.

Seller will supply up to date health record information to the buyer at the time of transfer of said puppy/dog along with Registration Application papers ( UNLESS the said puppy is being sold as a pet. Seller will hold the Registration papers until written proof of spay or neuter is provided from a Licensed Veterinarian.

 

All puppies are structure evaluated and temperament tested during the eighth week of age. At this time it is determined which puppies are pet and which are show quality.

 

Seller guarantee’s dog/ puppy to be sound and free of diseases at the time of transfer of said dog/ puppy to Buyer for a period of  (3) days. Buyer agrees to have said puppy examined by a Licensed Veterinarian within (3) days of receipt of said puppy .If the said puppy is to be found in poor health, upon a written statement from a Licensed Veterinarian Buyer will have three options.

 

1. To keep said puppy/ dog assuming all costs for it’s care.
2. Return said puppy/ dog at Buyers expense for a full refund of purchase price only upon the Seller’s receipt of  a Licensed Veterinarian’s written statement regarding the health of the said dog / puppy.
3. Get a replacement puppy of equal or greater quality when one becomes available

 

Seller has the right to request a second opinion from a non-associated Veterinarian.

 

HEALTH GUARANTEE : Seller guarantee’s this puppy against any inheritable / genetic defects up to 24 months of age. Seller will replace (of equal or greater value) with a signed statement from a licensed veterinarian for the following genetic defects:

1. Failure to receive a normal reading from Canine Eye Registration  Foundation.
2. Failure to receive a passing rating on hips from the Orthopedic Foundation For Animals.
3. Additional debilitating conditions due to genetic health problems must be discovered 24 months from birth of said dog / puppy. They must be submitted by two different veterinarians at two different clinics certifying that said dog / puppy is suffering from one of the following Epilepsy, Thyroid, immune suppression. At that time Buyer can either keep said dog / puppy and assume all medical expenses with a refund of half of purchase price from seller or return said dog / puppy at Buyers expense for a replacement puppy of equal value.

 

Seller reserves the right to refuse the sale of one of our puppies to anyone.
Seller has the right to , at any time decide to stop breeding Toy / Miniature Australian Shepherds. In this case, if a replacement puppy can not be given, then all monies for the purchase of the said dog / puppy will be refunded to the Buyer.
Seller makes no guarantees regarding accidental death, theft or sickness due to lack of vaccinations or proper care.

 

Buyer agrees that under NO CIRCUMSTANCE will they ever place said dog / puppy in an animal shelter, puppy mill or research facility.
Should Buyer relinquish the ownership of said dog / puppy this contract is null and void..

 

A $200.00 deposit is required to reserve a puppy. The said dog / puppy maybe paid for by the following.
1) Cash
2) Money Order
3) Cashier Check
4) By Check. This must be paid at least 10 days prior to transfer of said dog / puppy.

 

The Buyer has read and understands the foregoing and agrees that all parts of this contract are a binding agreement with the seller. If either the Buyer or Seller takes legal action regarding this contract, action will be initiated in the county of the Seller’s residence and legal fees and court costs shall be the responsibility of the party found at fault.

When purchasing a PET quality puppy,  buyer agrees to spay or neuter the said puppy, at which time the registration application papers for the puppy will be forwarded to the buyer. Evidence of Spay or Neuter must be provided by a licensed Veterinarian.
